Certaines familles monoparentales sont par exemple demandeuses d\u2019un arrangement de ce type qui permet, en plus d\u2019une r\u00e9duction des co\u00fbts, de partager un projet de vie et de lutter contre l\u2019isolement. Pour d\u2019autres la colocation permet d\u2019acc\u00e9der \u00e0 un meilleur logement ou tout simplement \u00e0 un logement.<\/p>\n<p>Ces projets de vie sont pourtant aujourd\u2019hui inenvisageables pour les b\u00e9n\u00e9ficiaires de revenus de remplacement en raison du taux cohabitant.<\/p>\n<p>Les familles devraient avoir le choix de leur forme d\u2019habitat quels que soient leurs revenus. Le statut de cohabitant interf\u00e8re avec cette libert\u00e9 puisqu\u2019opter pour une colocation peut conduire \u00e0 une diminution importante des revenus de remplacement et parmi eux, des allocations de ch\u00f4mage.<\/p>\n<p>En mati\u00e8re de droit au ch\u00f4mage, la notion de cohabitation est d\u00e9finie par l\u2019arr\u00eat\u00e9 minist\u00e9riel du 26 novembre 1991 mais son interpr\u00e9tation fait toujours d\u00e9bat. Une foisonnante jurisprudence a notamment vu le jour au regard des pratiques de l\u2019ONEM. L\u2019Office national de l\u2019emploi a en effet eu pour politique de consid\u00e9rer \u00e0 priori les colocataires comme des cohabitant\u00b7e\u00b7s, sanctionnant pour fraude certain\u00b7e\u00b7s colocataires qui s\u2019\u00e9taient d\u00e9clar\u00e9\u00b7e\u00b7s isol\u00e9\u00b7e\u00b7s et les for\u00e7ant \u00e0 rembourser une partie des indemnit\u00e9s per\u00e7ues.<\/p>\n<p>En octobre dernier, la Cour de cassation a eu l\u2019occasion de se prononcer sur la probl\u00e9matique. L\u2019ONEM demandait \u00e0 la Cour de casser un arr\u00eat reconnaissant le statut d\u2019isol\u00e9 \u00e0 des colocataires. La Cour a refus\u00e9 de suivre l\u2019argumentaire de l\u2019ONEM et estim\u00e9 qu\u2019en l\u2019esp\u00e8ce, il avait consid\u00e9r\u00e9 les colocataires comme cohabitant\u00b7e\u00b7s \u00e0 tort. Gr\u00e2ce \u00e0 cette jurisprudence, l\u2019ONEM semble reconsid\u00e9rer sa position et publie en f\u00e9vrier 2018 une directive qui \u00e9tablit les crit\u00e8res et documents qu\u2019il prendra en consid\u00e9ration pour d\u00e9finir la cat\u00e9gorie familiale des colocataires.<\/p>\n<p>Cependant, la charge de la preuve continue d\u2019incomber \u00e0 l\u2019allocataire social\u00b7e.
