Le statut p\u00e9nalise les citoyens qui per\u00e7oivent des allocations de remplacement lorsqu\u2019ils cohabitent avec d\u2019autres personnes. Ce mercredi 18 octobre, la Cour constitutionnelle doit se prononcer sur ce statut en mati\u00e8re de ch\u00f4mage.<\/p>\n<p><strong>Le statut de cohabitant en Belgique concerne 584.000 personnes<\/strong>(ch\u00f4mage, GRAPA, revenu d\u2019int\u00e9gration sociale, invalidit\u00e9, personnes handicap\u00e9es) dont <strong>155.500 ch\u00f4meurs<\/strong>. Ce statut est consid\u00e9r\u00e9 comme <strong>discriminatoire <\/strong>par une vingtaine d\u2019organisations r\u00e9unies au sein de la plateforme \u00ab\u00a0<a href=\"https:\/\/www.stop-statut-cohabitant.be\/\" target=\"_blank\" rel=\"noreferrer noopener\">Stop au statut de cohabitant.e\u00a0\u00bb. \u00a0<\/a><\/p>\n<p>Ces associations d\u2019horizons diff\u00e9rents* <strong>se mobilisent \u00e0 la veille d\u2019un nouveau d\u00e9bat\u00a0sur ce statut d\u00e9cri\u00e9<\/strong>. Ce mercredi 18 octobre, la Cour constitutionnelle doit se prononcer sur ce statut en mati\u00e8re de ch\u00f4mage au regard de la Constitution et du droit europ\u00e9en de l\u2019\u00e9galit\u00e9 entre hommes et femmes.<\/p>\n<p>\u00ab\u00a0<em>L\u2019enjeu est de reconna\u00eetre que ce statut \u2013 <strong>injuste et pr\u00e9carisant<\/strong> les personnes qui per\u00e7oivent des allocations \u2013 est <strong>contraire aux articles 10 et 11 de la Constitution qui consacrent la non-discrimination des citoyens belges et ainsi qu\u2019au droit de l\u2019\u00e9galit\u00e9 de traitement entre hommes et femmes prescrit par le droit europ\u00e9en notamment\u00a0<\/strong><\/em>\u00bb, plaident les dix associations.<\/p>\n<p id=\"un-statut-injuste-et-precarisant-les-personnes-qui-percoivent-des-allocations\" class=\"wp-block-heading\"><strong>\u201cUn statut injuste et pr\u00e9carisant les personnes qui per\u00e7oivent des allocations\u00a0\u00bb<\/strong><\/p>\n<div id=\"below_para_2\">\n<div class=\"bcContainer-IC\">\n<p>Le probl\u00e8me du statut de cohabitant est li\u00e9 au fait que <strong>la situation de la personne est prise en compte pour fixer les allocations de remplacement auxquelles elle a droit<\/strong>: CPAS, ch\u00f4mage, handicap. Ces personnes voient aujourd\u2019hui <strong>leurs allocations diminuer<\/strong>, car elles cohabitent sous le m\u00eame toit que d\u2019autres personnes\u00a0qui travaillent.<\/p>\n<p>En fin de d\u00e9gressivit\u00e9 de ses allocations (troisi\u00e8me p\u00e9riode), un b\u00e9n\u00e9ficiaire d\u2019allocations de ch\u00f4mage per\u00e7oit <strong>1.296,36 euros en tant qu\u2019isol\u00e9 et 672,88 euros s\u2019il cohabite<\/strong>. Le revenu d\u2019int\u00e9gration sociale d\u00e9pend \u00e9galement de la situation familiale et de la cohabitation. Ainsi, <strong>une personne cohabitante avec charge de famille re\u00e7oit 1.673 euros, une personne isol\u00e9e 1.238 euros et 825 euros en tant que cohabitante<\/strong>. Aujourd\u2019hui, <strong>la majorit\u00e9 des personnes au ch\u00f4mage sont des femmes<\/strong> (51,4 % de femmes contre 39,9 % d\u2019hommes). En 3\u00e8me p\u00e9riode de ch\u00f4mage, on compte 38, 54% de femmes et 24,11 % d\u2019hommes, selon les donn\u00e9es de l\u2019ONEM.<\/p>\n<p>\u00ab\u00a0<em>Pourtant, ces personnes, lorsqu\u2019elles avaient un emploi, <strong>contribuaient \u00e0 la s\u00e9curit\u00e9 sociale<\/strong> selon un taux de cotisation identique\u00a0\u00bb<\/em>, avance le collectif d\u2019associations. Il d\u00e9nonce \u00e9galement le fait que les personnes sous ce statut sont \u00ab<em>\u00a0<strong>contr\u00f4l\u00e9es, traqu\u00e9es, soup\u00e7onn\u00e9es par l\u2019ONEM<\/strong> de maquiller leur cohabitation afin de recevoir les m\u00eames allocations que les personnes cat\u00e9goris\u00e9es isol\u00e9es\u00a0\u00bb.<\/em><\/p>\n<p id=\"un-modele-familialiste-depasse\" class=\"wp-block-heading\">\u00ab\u00a0<strong>Un mod\u00e8le familialiste d\u00e9pass\u00e9\u00a0\u00bb <\/strong><\/p>\n<p>Ce statut<strong> cr\u00e9\u00e9 il y a 40 ans et fond\u00e9 sur un mod\u00e8le familialiste<\/strong>, est de plus en plus en <strong>d\u00e9calage <\/strong>avec l\u2019\u00e9volution de la soci\u00e9t\u00e9. \u00ab\u00a0<em>Aujourd\u2019hui, la <strong>colocation<\/strong>, qui am\u00e8ne plusieurs personnes sans lien particulier \u00e0 vivre sous le m\u00eame toit, le logement <strong>interg\u00e9n\u00e9rationnel <\/strong>ou m\u00eame l\u2019habitat group\u00e9 sont souvent une solution aux probl\u00e8mes d\u2019acc\u00e8s au logement et d\u2019augmentation du co\u00fbt de l\u2019\u00e9nergie. De nombreuses personnes, qui pour <strong>prendre soin d\u2019un parent, d\u2019un enfant devenu adulte,<\/strong> mais porteur de handicap voudraient vivre ensemble, notamment pour faire des \u00e9conomies d\u2019\u00e9chelle, mais en sont emp\u00each\u00e9es en raison du risque de<strong> p\u00e9nalisation li\u00e9 \u00e0 ce statut de cohabitant. <\/strong>Or, les crises successives, sanitaire, \u00e9conomique et sociale, ont d\u00e9montr\u00e9 les besoins accrus de solidarit\u00e9<\/em>\u00a0\u00bb, argumentent par voie de communiqu\u00e9 les porte-parole des associations qui militent contre ce statut depuis des ann\u00e9es.<\/p>\n<p id=\"la-plupart-des-partis-favorables-a-la-suppression-du-statut-de-cohabitant\" class=\"wp-block-heading\"><strong>La plupart des partis favorables \u00e0 la suppression du statut de cohabitant <\/strong><\/p>\n<p>La plupart des partis \u2013 \u00e0 l\u2019exception de la NVA et du CD&amp;V \u2013 sont favorables \u00e0 la suppression de ce statut. <strong>Le PS a d\u00e9pos\u00e9 en septembre dernier une proposition de loi afin d\u2019y mettre un terme.<\/strong><\/p>\n<p>La Cour des comptes a chiffr\u00e9 <strong>le co\u00fbt de l\u2019alignement <\/strong>des allocations pour cohabitants sur les allocations pour personnes isol\u00e9es \u00e0 <strong>1,86 milliard d\u2019euros<\/strong> pour l\u2019ensemble des prestations sociales, dont 446.000 euros pour la branche ch\u00f4mage. Un co\u00fbt consid\u00e9r\u00e9 comme \u201ctout \u00e0 supportable\u201d par les socialistes.<\/p>\n<p><strong>Le terrain semble donc de plus en plus propice \u00e0 un changement dans la l\u00e9gislation et les mentalit\u00e9s.<\/strong> Pour preuves: r\u00e9cemment, les\u00a0autorit\u00e9s ont \u00e0 plusieurs reprises<strong> lev\u00e9 la distinction entre isol\u00e9 et cohabitant pour l\u2019octroi d\u2019allocations,<\/strong> notamment lors de la <strong>crise sanitaire<\/strong> pour \u00e9viter de p\u00e9naliser les travailleurs en ch\u00f4mage temporaire.
